Terms of Service

These Terms of Service ("Terms") govern the custom website, digital menu, printable QR card, and hosting service (the "Services") provided by Oliver Fritsche, doing business as "Ahead Kitchen" ("Ahead Kitchen," "we," "us"), to you and the restaurant you represent ("you," "Customer"). By starting a plan, requesting a demo, or paying an invoice, you agree to these Terms.

1. The Services

Ahead Kitchen builds and hosts a custom website and digital menu for your restaurant, generated in part from your existing public online presence. Depending on your plan, the Services include hosting with HTTPS on your own domain, a printable QR menu card, a self-serve menu editor, basic search and Google Business setup, and a periodic refresh of your site. Optional add-ons (such as online ordering) may be offered for an additional fee. The specific deliverables and fees for your plan are described in the plan or order you accept.

3. Your Content & Your Rights

"Customer Content" means any text, images, logos, menus, photographs, reviews, trademarks, or other materials you provide to us, edit through our tools, or direct us to use. You represent and warrant that:

You are solely responsible for the accuracy of menu items, prices, hours, and other information published on your site, including changes you make through the self-serve editor. You will promptly tell us of any corrections needed.

4. What You Own & Your License

You own your Customer Content, and you own or control your own domain name. For as long as your plan is active, we grant you a non-exclusive, worldwide license to use the website and menu we build and host for you. If you cancel, you may request an export of your finished site (its static files) so you can host it elsewhere; we will not withhold your site. The underlying platform, templates, generation tools, and know-how we use to produce and operate sites remain our property and are not included in that export. We may reference the work we did for you as a portfolio example unless you ask us in writing not to.

5. Hosting & Availability

Where we host your site, we use commercially reasonable efforts to keep it available, fast, and secure, but we do not guarantee uninterrupted or error-free operation. Hosting depends on third-party infrastructure providers whose availability is outside our control.

6. Acceptable Use

You agree not to use the Services for any unlawful purpose, to publish content that is illegal, infringing, deceptive, or harmful, or to attempt to disrupt or gain unauthorized access to our systems.

7. Cancellation & Refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.

8. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will increase your revenue, traffic, search ranking, or reservations.

9. Limitation of Liability

To the maximum extent permitted by law, Ahead Kitchen will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Services will not exceed the total fees you paid to us in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Ahead Kitchen from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Content, your breach of these Terms, or your violation of any law or third-party right.

11. Term & Termination

Your plan continues month to month until cancelled. Either party may cancel as described in the Refund & Cancellation Policy. We may suspend or terminate the Services if you breach these Terms or fail to pay. Sections that by their nature should survive termination (including Sections 3, 4, 9, and 10) will survive.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and your continued use of the Services constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. The state and federal courts located in Massachusetts will have exclusive jurisdiction over any dispute that is not resolved informally.
