Ahead Kitchen builds a custom website and digital menu for your restaurant, generated in part from your existing public online presence, and may provide a printable QR menu card and ongoing hosting and maintenance. The specific deliverables, scope, and fees for your engagement are described in the quote or order we provide and that you accept.

"Customer Content" means any text, images, logos, menus, photographs, reviews, trademarks, or other materials you provide to us or direct us to use. You represent and warrant that:

You are solely responsible for the accuracy of menu items, prices, hours, and other information published on your site. You will promptly tell us of any corrections needed.

4. Our Work & License to You

Upon full payment of the applicable fees, we grant you a non-exclusive, worldwide license to use the website and menu we deliver for your restaurant for as long as your engagement with us is active. Underlying tools, templates, code frameworks, and know-how that we use to produce sites remain our property. We may reference the work we did for you as a portfolio example unless you ask us in writing not to.

5. Hosting & Availability

Where we host your site, we use commercially reasonable efforts to keep it available, fast, and secure, but we do not guarantee uninterrupted or error-free operation. Hosting depends on third-party infrastructure providers whose availability is outside our control.

6. Acceptable Use

You agree not to use the Services for any unlawful purpose, to publish content that is illegal, infringing, deceptive, or harmful, or to attempt to disrupt or gain unauthorized access to our systems.

7. Cancellation & Refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.

8. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will increase your revenue, traffic, search ranking, or reservations.

9. Limitation of Liability

To the maximum extent permitted by law, Ahead Kitchen will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Services will not exceed the total fees you paid to us for the Services in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Ahead Kitchen from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Content, your breach of these Terms, or your violation of any law or third-party right.

11. Term & Termination

Either party may terminate an ongoing hosting engagement as described in the Refund & Cancellation Policy. We may suspend or terminate the Services if you breach these Terms or fail to pay. Sections that by their nature should survive termination (including Sections 3, 4, 9, and 10) will survive.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and your continued use of the Services constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of [GOVERNING-LAW STATE], without regard to its conflict-of-laws rules. The state and federal courts located in [GOVERNING-LAW STATE] will have exclusive jurisdiction over any dispute that is not resolved informally.
